Terms and Conditions

Article 1 Facility & Exploitation

Siemens offers its employees the opportunity to participate in the company fitness programme. High Five Health Promotion B.V. (High Five) offers this service.

Article 2 Participants

The following persons can use the Studio Active Erlangen at Schuckerstraße 1:

  1. Employees (permanent and temporary) of Siemens AG, Siemens Mobility GmbH and Siemens Financial Services.
     
  2. Family members of active members of SAG, SMO, SFS
    - who live in the same household as the member
    - are over 18 years of age

     
  3. Employees (permanent and temporary) of all companies with SIEMENS in their name (see list)

    - SIEMENS Electronic Design GmbH
    - SIEMENS Energy Global GmbH
    - SIEMENS Finance & Leasing GmbH
    - SIEMENS Healthineers AG
    - SIEMENS Industry Software GmbH
    - SIEMENS Project Ventures GmbH
    - SIEMENS Treasury GmbH

  4. In the case of exceptions, Siemens will decide whether participation is possible.

Article 3 Registration

Registration for participation in health and fitness activities is carried out digitally via High Five Connect. Participants can register via the homepage and view their test data, invoices, direct debit authorisations, training programmes, bookings and opening hours on their personal page in High Five Connect. High Five works in accordance with the GDPR. During registration, the new participant is explicitly asked to consent to the processing of personal data. In addition, the participant is asked to agree to the health agreement and the house rules.

Article 4 Start of participation

Before the participant starts the training programme, High Five recommends that a fitness test be carried out. High Five carries out a medical history as part of the check-up. If the questions/answers in the medical questionnaire do not reveal any serious, severe physical limitations, participation in the health and fitness activities can begin immediately.

Article 5 Reporting injuries

If a member is aware of an injury or wound, this must be reported to the employee before the start of training, in accordance with the health agreement.

Article 6 Liability

Participation in the activities of High Five is exclusively at the participant's own risk. Siemens or High Five cannot be held liable for material damage, personal injury or damage of any other nature, loss or theft, unless this is the result of non-functioning equipment due to improper supervision of the maintenance of the equipment or improper supervision of safety in this area. All equipment may only be used for its intended purpose. Every member is obliged to inform themselves about the instructions for use and operating instructions before using training equipment and to observe these when using the equipment. In the event of any uncertainties in this regard, in particular before using the equipment for the first time, instruction must be obtained from the fitness centre operator or its employees. All facilities, training equipment and training areas must be treated with care and respect. Items brought into the gym must be stored properly in the storage boxes provided and may not be left behind in the gym. Every member must refrain from making unnecessary noise, causing a nuisance or endangering other members.

Article 7 Reporting defects and malfunctions

If a member notices that a piece of equipment is not working properly, they are requested to report the damage immediately to a High Five employee.

Article 8 Hygiene

The use of a towel during training is required. Each participant must clean and/or tidy up the equipment and materials after use. Every participant must wear clean training clothing and indoor shoes. Training on the training area with flip-flops, barefoot or with open shoes is not permitted. We recommend wearing bathing sandals in the wet areas. We urge you to leave all rooms clean and tidy. All items must be removed from the lockers at the end of the training session, reservations are not possible. High Five reserves the right to remove any items left behind from the lockers and rooms.

Article 9 Food and drinks

It is prohibited to eat in the workout areas. Chewing gum is prohibited during workouts. Drinking in the workout area is only permitted from your own (non-glass) sports bottle.

Article 10 Opening hours

During opening hours, all members have unlimited use of the fitness facilities. Supervised opening hours and activities are shown in the overview of bookable hours on the personal page in High Five Connect. An alternative schedule can be integrated during holiday periods. Participants can register to take part in group courses and other activities in High Five Connect. If a participant is unable to attend a group course, they will be asked to cancel their booking at least one hour before the start of the course to allow other members to attend.

Article 11 Schedule changes

With the agreement of Siemens, High Five may make changes to the timetable.

Article 12 Payment of personal contribution

The monthly membership fee is paid in advance by direct debit. If payment is made by direct debit, a direct debit agreement must be signed prior to participation.
A deposit of € 10.00 is charged for the membership card. This will be refunded upon termination of membership and return.
In the event of loss, a new membership card will be issued for a fee.

Article 13 Termination

Cancellation periods and terms: Monthly membership is automatically extended by one month at the end of the initial term until written notice of cancellation is received. 10-time cards are debited as a one-off payment and can no longer be cancelled once the first training session has started. The member is obliged to check in independently before the training session. The check-in system automatically deducts the credit stored on the membership card. Membership can be cancelled with four weeks' notice to the end of the month. The member must send the cancellation by email to the email address fitnesssiemenserlangen@highfive.fit. High Five must receive the cancellation before the first of the month. Cancellations received after the last day of the month will be processed in the following month. Each participant is asked to provide a reason for cancellation. Emails received will be acknowledged and processed by High Five. In the event of injury and/or pregnancy, membership may be temporarily paused.

Article 14 Complaints and/or suggestions for improvements

If a participant has complaints and/or suggestions for improvement, these can be passed on to a fitness trainer or the contact person at Siemens. Complaints and suggestions can also be submitted on the website: https://www.highfive.fit/en/suggestion-or-complaint

Article 15 Photo and videos

Photography and video recordings are not permitted without written permission from the Communications Department of High Five and Siemens.

Article 16 Rules

We assume that every participant has taken note of the contents of the terms & conditions and house rules. The current rules can be viewed on the personal page in High Five Connect. High Five and Siemens have the right to change these rules.

Article 17 Unforeseen circumstances

In cases not covered by the rules, a decision will be made by Siemens and High Five.

Article 18 Extended opening hours (unattended)

The member is aware that the High Five staff is only permanently on site from Monday to Thursday from 6:30 a.m. to 8:30 p.m. and on Friday from 6:30 a.m. to 7:00 p.m. (regular opening hours). 

The use of the facilities and training equipment outside of these times is the sole responsibility of the member, without supervision by High Five during these times, so that constant traffic safety cannot be maintained, and in particular the use by the member is unsupervised and without instruction by High Five or authorized third parties, so that the use of the facilities during these times is at the member's own risk.  In particular, the Member is aware that training and the associated physical exertion in conjunction with the lack of supervision creates a potentially increased risk, especially since physical or health emergencies may not be immediately recognized due to the lack of staff. The Member is aware of and accepts this risk.

The Member further understands that the entire area of use outside of regular business hours is a self-check area and that the Member must inspect the premises and training equipment for any safety defects prior to use. Defects or hazards may arise, for example, if previous users have improperly used or left unsecured the premises or training equipment.

In particular, it is the member's responsibility to check his or her own abilities and state of health, i.e. whether he or she is physically and/or mentally capable of using the training facilities independently, prior to commencing training.

However, this disclaimer does not apply if High Five or its representatives or vicarious agents have acted with intent or gross negligence and the damage was caused as a result. This also applies in the case of culpable violation of essential contractual obligations.

In the case of simple negligence, it also does not apply to injury to life, body or health. Liability for culpable injury to life, body or health remains unaffected.

Unless otherwise expressly provided above, High Five's liability is therefore excluded outside regular business hours.

Important information for training without supervision

To ensure the smooth and safe operation of training without supervision, please follow these steps:
 

  1. sign in before each training session
    Before each training session without supervision, you must sign in at the SP10 reception desk using the list provided.
     
  2. deposit & issue of access card
    Your (company ID-) and membership card must be handed to the security staff at the SP10 reception desk as a deposit. In return, you will receive an access card for the Studio Active and a locker key.
     
  3. Returning after training
    After your workout, you must return your access card and locker key to Reception SP10. Only then will you receive your (company ID-) and membership card back.

     
  4. Respecting the rules
    The house rules and general terms and conditions must be observed at all times during training

     
  5. registration procedure
    By accepting the extended terms and conditions, the member also accepts the currently posted registration procedure.
